Donna Kauffman recaps classic 'NCIS' season 9 episode 'Devil's Triangle'

We’re back on the Classic NCIS Recap Couch! My latest manuscript is in the can (read: on my editor’s desk, not mine), and I am SO ready to dive back into some Classic Gibbs!

This week we’re going back to season nine and an episode that brings together a few of our favorite things: Gibbs, Fornell … and Diane. Aptly titled Devil’s Triangle, let’s settle in and enjoy the fireworks, shall we? Pass the popcorn!

We open with a man pulling through a fast-food drive-through, totally ordering a cheat meal when wifey calls and catches him in the act. He claims an incoming call as he pulls up to the window to collect his yummy yummy burger and fries, clicks off still-yelling wifey and tells the drive-through attendant that his wife just worries about him. You know, like one burger is going to kill him. Turns out, the more immediate deadly thing is the drive-through attendant, who shoots a blow dart through the burger bag into Diet Cheater’s neck. #didyouwantablowdartwiththat? #unhappymeal.

Cue awesome opening credits (hello, yellow Dodge Challenger!) and equally awesome theme music.

Then we’re in the Bull Pen of Orangey Goodness as McGee and Ziva enter to find Tony fretting over the increasing number of hairs going down his shower drain every morning. He manages to get McGee worried about his receding hairline, but Ziva assures them both they are not going bald and that even if their hair is thinning a little, “It’s not like it’s turning gray,” she adds. Aaaand, yeah. We all know who has walked in right behind her. Tony is all, “I’m so glad that wasn’t me,” as she closes her eyes. HA! She turns and assures Gibbs that gray can be really sexy (oh yeah, it can!), but he’s on his phone and heads to his desk. She, and the rest of us, are sure that will come back to bite her later. He hangs up, and McGee asks if they have a dead body. Gibbs says, “Worse.” They ask where they are going, and he tells them nowhere, then heads outside to the coffee stand, where he meets up with (yay!) FBI Agent Fornell. Fornell isn’t nearly as happy about this as I am. They realize that they have both been summoned. Gibbs drinks coffee. Fornell chugs Pepto. And up walks their favorite ex-wife, Diane.

She informs them that her current spouse of six months didn’t return home the night before and she wants them to help her find him. (Oh, so Diane is Yelling Wifey. Why are we not surprised?) Needless to say, neither Gibbs nor Fornell appreciate being called in like they’re her personal security task force, but she makes a serious plea for their assistance. Fade to black and white mid-Gibbs-eye-roll. (We might need a free refill on that popcorn bowl!)

We come back to the NCIS conference room with Diane telling the exes that her hubby was working late as a data storage coordinator for Homeland Security and never made it home. Her last contact was the phone call at 10 the previous night. Fornell comments his job sounds important. Diane corrects him, says it’s not, and Victor (hubby) likes it that way. “He’s not married to his job. He’s married to his wife. A novel concept for the two of you, I’m sure.” (Maybe the faux reality show needs her in the backseat “helping” the team. HA! I’m so sorry about season 13, Diane. Sorrier than you know.) Gibbs assures her his team is running down all the info they can, checking his credit card, calling local hospitals and the like, but so far, there is no evidence of a crime. Fornell thinks maybe Victor could be taking a little break. “The three of us know that wouldn’t be the first time.” Heh. She assures them this marriage is different, then goes on to point out all the ways Victor is different, by highlighting all the things that were wrong with the two of them. Oh, Diane. You want their help, remember? Ultimately, she tells them they must think something is off, too, or she wouldn’t be standing there.

Gibbs pauses, then opens the conference room door, to find all three of his team members crouched by the keyhole, wanting a look at the ex. Tony whispers, “Red hair,” to Ziva, then they tell Gibbs that they got a hit on Victor’s credit card from the burger joint in D.C. the night before. McGee then reports that the morning crew put in a 911 call when they found “a bloodbath.” Naturally, Diane looks like she’s going to faint. Smooth, McGee. Real smooth.

We shift to the cold storage room at the burger joint and the two dead employees, shot execution style. Tony notes that they are both local, and one of them has really good hair. Oh, Tony. Ziva reports nothing is missing from the register and there is security footage. Car still sitting in the drive-through is Victor’s, with a wallet still there, and a gun near the car. Fornell is annoyed to hear this, mostly because it means he has to tell Diane she was right. Heh.

Ducky shows up, a wee bit cranky. Says he hasn’t slept well that week. At least the bodies are “on ice,” as it were. “How considerate,” he says. Ziva reports the security footage has been erased. With two dead bodies and a missing Homeland Security employee, Fornell asks Gibbs if he knows what Fornell is thinking and Gibbs posits that maybe Victor was so desperate to get away from Diane he faked his own kidnapping? HA. Enter a Mr. Slick Young Buck in a suit who hands them his Homeland Security business card and says that idea might make more sense than the alternative. He then explains he’s only budgeted 20 minutes for their little meeting, so, chop-chop. Tony’s reading my mind, asking, “Who’s this clown?” Fornell wants to know what that other alternative would be, and Mr. Slick is all, Well, that someone might want to kidnap Victor. Fornell reminds him that, oh, given his employer, maybe a terrorist? Slick assures them that Victor had zero access to anything other than travel logs and the like.

Meanwhile, Tony is admiring Slick’s hair, then pondering what kind of game Diane must have to have landed both Fornell and the “wild Savannah, untamed” that is Gibbs. Gibbs tells Slick they still want to see whatever Victor was working on, and Fornell is wondering why Slick isn’t more concerned that one of his employees has gone missing. He assures them he is, but at the moment, he’s more concerned about telling his department they’ll have to make a shift to a different kind of data storage, and steps away on a conference call. Gibbs and Fornell have their own 99 problems. One is telling Diane she was right, and worse, that they don’t know what happened to Victor. Fornell happily leaves that task to Gibbs as he heads back to his own HQ to run background on the two dead burger joint employees.

We shift to Gibbs entering Abby Lab for an update. Abs is sporting an open-back black jumpsuit over red vinyl … something. I’m sure you have no problem imagining that. It’s Abby. She explains that she has questions. Gibbs says, “Shoot,” and she starts on a long list of questions about his divorce from Diane and how and when Diane and Fornell met and was he jealous. You can imagine Gibbs’ enthusiasm meter for this line of questioning. She asks the dead-silent Gibbs for a do-over. He dutifully exits, re-enters, asks her what she’s got, and this time we go directly to security footage. Heh. She’s trying to unscramble some of the erased footage. In the meantime, she reveals that the gun at the scene was registered to Victor and has been fired, possibly for the first time. And, oh yeah, did it bother Gibbs when Diane chose a husband so opposite from him? Again, you can imagine her success ratio for this repeated attempt. Also zero. She says his prints were on the gun, so maybe he put up a fight. More interesting is what she didn’t find. His wallet was obsessively organized, and one of the credit cards was missing. Gibbs wants to know if she could tell which one. She says no, then tells him, quite pointedly, that she has more questions than answers. Heh.

We shift to Fornell coming into the bull pen. After a few Tony quips about marriage, we learn that one of the dead burger joint employees was a Navy reservist and the other a recently divorced aspiring model. Turns out that divorce was amicable. “Go figure,” Fornell says, then goes on to reminisce about how Diane cleaned out their bank accounts and even took Gibbs’ grandfather’s watch. Tony, of course, is loving this and encourages Fornell to just let it all out. Gibbs wishes otherwise. Enter Ziva and Tony, who have done the background on Victor. He has worked for Homeland for five years, lives a simple modest life, just as Diane said. Except for that long list of offshore banking accounts and all the money tucked away there forthwith. Fornell wants to know where it all came from. Gibbs wants to know why he’s hiding it. Fade to black and white.

We come back to the two in Vance’s office. Vance wants to know what Diane said about the money. They don’t think she knows about it, and each wants the other to be the one to ask her. Vance is all, “Have fun finding out,” and tells them how the case will be divided up between them, and comments that dealing with Diane can’t be all bad if they both married her. Which is when she bursts into the office, demanding to know why they hadn’t told her about the $2 million in Victor’s accounts. McGee follows, saying she dragged it out of him. Vance steps in to tell her they are doing all they can, and she is only slightly mollified, saying she wants to be kept informed. Gibbs tells her they can talk about it downstairs, prompting her to ask if he has a basement there, too, and calls him Mr. Woodchuck, then grouses about how hard it was to get the information out of “McCaulay Culkin” aka McGee. She’s on a roll!

She spies Victor’s wallet and the blood on it. They reassure her the blood is not his. They mention one credit card was missing, and she asks from which pocket. They raise their eyebrows at this, like how would she know what card was in which pocket, and she immediately runs down a list of what Gibbs carries in his wallet, including a photo of his late wife, Shannon, then turns to Fornell and begins on his. He stops her after “condom beneath the fold on the left side.” HA! She tells them she didn’t know what was in that pocket in Victor’s wallet, that it had no name on it, but she does remember the logo.

We shift to Tony and Ziva entering a big office building with no windows, called Iron Crypt. Tony is opining that snooping in a man’s wallet is crossing the line, and Ziva wonders if maybe Victor did something to cause her mistrust, especially given he was hiding all that money. A little security beeper sound goes off and a man on what looks like a modified three-wheel Segway with flashing lights scoots around the corner behind them. He is there to greet them, totally adorkable, and immediately tells Ziva she’s hot. Tony thinks he must not get out much, and Totally Adorkable agrees. Tony shows him a photo of Victor and TA tells them he’s there every few months to do a system check, then tries to impress Ziva with how hot and sexy data storage is. They tell him Victor has been kidnapped. He’s all, “That’s terrible,” and asks Ziva if she wants to get a drink to talk about it. Oh, TA. Tony yanks TA’s security card away from his body, asks if they can tell when Victor used his last, then he lets the retractable lead snap the card back to TA’s belt. Wince. He says he can absolutely do that, and TA tells her she has the softest-looking skin. She’s all, That’s borderline creepy, and he’s all, Yeah, I know, I’m working on it. Heh. Victor’s card was used once after his kidnapping. TA pulls up security footage and they see it was actually Victor, alone, entering the server room.

Back in the bull pen, Fornell is surprised by the recent revelation. Turns out Victor went in, downloaded one file, then erased the file on the server before logging out. So they don’t know what file he took. Tony thinks that Gibbs and Fornell need to figure out what might be missing by comparing Victor to the two of them, seeing as Diane married all three of them. Perhaps that would give them a lead. They aren’t enthused with his line of logic. Ziva says someone should make sure Diane hasn’t heard from Victor, and they agree that’s a better place to start. Gibbs turns to head out, and Fornell chases after him, telling him the conference room — and Diane — are in the opposite direction. Gibbs is all, “I know. I’m heading to autopsy.” He leaves and Fornell turns to Tony and, in his best Gibbs voice, orders him to go question Diane … then scoots out after Gibbs. Heh.

Down in Ducky’s Digs, he’s holding court with his two autopsy subjects on the history of divorce. Fun fact: Divorce in Ireland wasn’t legal until 1997. Enter Fornell and Gibbs, the former of whom is thankful he’s not Irish. He asks Gibbs if he can imagine being stuck with Diane, and he’s all, “What do you mean? We are.” HA. Unfortunately, the autopsies reveal no new leads, but there was a curiosity. The two employees had their hands bound together when they were shot, but there are no marks on their wrists. It would be odd that they didn’t struggle, and they weren’t drugged, so perhaps they were just faking being hostages and the crime scene was set up to be a fake? Only the bullets that killed them sure weren’t fake. Ducky opines that maybe they outlived their usefulness. Also? The bullets used to kill the two were fired from Victor’s gun. Ruh roh. Fornell starts chugging Pepto again.

Up in the conference room, Tony is questioning Diane, who insists she has had no contact with Victor. Tony is also still trying to figure out how Diane landed both Gibbs and Fornell. She leans in, all smoky voice and pursed lips, and tells him she could explain, only then he wouldn’t be able to concentrate on the case. Tony says, “That ship has already sailed.” Heh. Naturally, Gibbs walks in just then, along with Fornell, and Tony quickly straightens. Diane learns that Victor is a suspect now, and Tony shows her the security footage of Victor in the server room, stealing some file. Diane doesn’t understand why he’d do something like that, but enter Abby, who thinks she might. She has figured out what file Victor downloaded. It’s a recipe for a deadly virus. Serious faces. Fade to black and white.

We come back to Abby Lab, and we get to see Lab Tech Carol! (We need some Carol in season 14. Miss her!) Carol flirts shamelessly with Fornell as she explains how DNA is coded into numbers and these long-ago coded viruses can now be made synthetically, so the code becomes a recipe of sorts. Abby thinks maybe Victor is looking to score from selling the code, because if he was personally wanting to perform an act of terror, there were far deadlier viruses stored on the server. With a wink to Fornell, Carol gives them the address of the only lab capable of making man-made viruses.

Gibbs, Fornell and Ziva enter through the unlocked front door of the empty lab facility. Ziva sees a body on the floor. Dead security guard. In a locked lab room, they find a room full of dead bodies and the empty rack that contained the virus they made. So, that’s not good.

In the bull pen, Tony tells the gang that the hazmat team has almost cleared the lab, so then Ducky can autopsy the bodies. Two of the dead bodies were lab techs, the other two were former Special Forces who flipped to the mercenary side. McGee comes in with some restored tape from the burger joint, which shows the two mercenaries herding the two employees into the cold storage room. So how did the mercenaries go from perpetrators to dead? They try to track it all back to Victor faking his own kidnapping, and McGee and Tony reveal that in checking both Victor’s and Diane’s backgrounds, that although Diane said she hadn’t left the country, McGee found that she had made two trips to the Cayman Islands, aka money-laundering capital of the world. Fornell might despise the woman, but she is also the mother of his child, and he honestly doesn’t think she’d be in on something like this. Which brings Gibbs to Rule No. 69: Never trust a woman who doesn’t trust her man. Heh. Tony and McGee are instructed to keep digging. How deep? Until they get to the bottom. Fade to black and white.

We come back to Gibbs in his basement, painting what looks like a door. In comes a strident Diane, calling him an SOB for poking into her personal business. He tells her he is just doing his job, and she corrects him about who is the missing person, and it’s not her. Gibbs remains unperturbed by her histrionics. He asks her about the Caymans, and she pleads ancient history. She sees two drinks on the table and accuses him of expecting her. He says no, but offers a drink. She declines and wonders out loud if he’s been waiting all these years for the opportunity to “twist the knife.” He shakes his head, says that’s her specialty. Boom! She accuses him of using her as a human antidepressant, marrying her as a way to get over losing Shannon. He looks away at that, and she apologizes. He asks again about the Caymans. She takes the drink, for courage, and tells him she had met someone who happened to have a place in the Caymans. She was lonely, with a spouse who worked all the time, and this guy paid attention to her. She tells him that’s all she ever wanted. Someone to pay her a little attention, to be there for her. Gibbs smiles, says she should marry him. Diane smiles and says she did, six months ago. She thanks Gibbs for the waffle iron, says Victor loves it. Abashed now, she says that whatever they think Victor did, they’re wrong. “Find him and see,” she says, then more quietly, “Just … find him. Please.”

She exits … and from the shadows, out walks the owner of that other drink … Fornell. HA. He asks Gibbs why he didn’t tell Diane he was there. Gibbs asks him why he didn’t announce himself. Fornell is coming to terms with the revelation that Diane just confessed to cheating on him with Victor. “Now I really want to find the son of a bitch,” Fornell says, then pours himself another drink. Heh. Gibbs takes a phone call from McGee, who has a location from the last call made from one of the now dead mercenary’s cellphone. Tony is on his way to that location now. Gibbs keeps Fornell from drinking, and off the two of them go.

Move to the dark warehouse, Gibbs and Fornell enter, guns drawn. The place is full of boxes and office equipment, and there is a single light glowing in the back. They come up on the small fenced room where the light is and shout, “NCIS” and “FBI.” Victor immediately yells back, “DSC,” and they’re like, what’s DSC? Data storage coordinator, Department of Homeland Security, he explains, sitting at a computer terminal, looking beyond frazzled and not a little frustrated. As they come out of the shadows, Victor smiles, all, “Leroy? Tobias?” He’s so relieved to see them, and given he’s padlocked in the little chain-link cell, it’s understandable. They hatchet their way in, and Victor throws some shade for them both missing the wedding. Gibbs and Fornell simultaneously say, “Work.” Victor forgives them, then hugs Fornell and tries to hug Gibbs, but he moves back out of leash range. Victor is shackled to his table by the ankle.

We move to an interrogation room, and Victor wants to know why he’s being debriefed there. Gibbs starts tossing photos in front of him, and Fornell says he has a lot of explaining to do. He claims he’s being set up, doesn’t know by who, but they threatened to kill Diane if he didn’t go through with it. Fornell and Gibbs need a lot more than his claims of being set up, and he’s a little indignant that they think that of him. In barges Diane, who was watching through the two-way glass. She lays into Victor about having $2 million on hand while she’s sweating paying the mortgage. He immediately looks to Gibbs and Fornell, who both are like, “This is your problem.” HA. Victor explains that he inherited the money, and having that much money makes it hard to tell who your friends are, so he never talked about it, wanting to make sure she wanted him for him. He’s all, “It’s our nest egg. I was going to surprise you when I retired.” She is still so angry at him, saying he didn’t trust her to love him rich or poor, but married her anyway, and swears she’ll make his life a living hell. He merely smiles, gets up, tells her he’s OK, she doesn’t have to be scared. She launches herself into his arms, sobbing, so thankful he’s OK. Gibbs and Fornell exchange looks of “what the?” HA. Highlight of the episode. Fornell breaks up their little reunion and demands to know who they are selling the virus to, which is when Victor realizes they have it figured all wrong. Whoever it was that stole the virus isn’t planning on selling it. They’re planning on using it. Fade to black and white.

We return to Vance’s office, with Gibbs, Fornell, Victor and Slick, who assures Victor he’ll be getting overtime for his entire ordeal. Oh jeez. Vance says that Ziva believes the attack is going to be that day. Victor says he used some old data processing equipment stored in the cell he was chained in to hack in and hear a little bit of the conversation between his captors and believes that, yes, today is the day. He has no idea what the target is.

A call to Gibbs sends him down to Abby Lab. Cutting to the chase for Gibbs’ sake, she tells him she was able to pull the last few seconds of the conversation that Victor overheard, confirming the attack is that day and mentions a game. There is a football game that day honoring the military, so a lot of high-ranking officials will be there. But since the virus is spread by touch, how would that work? Abby found a machine where Victor was being held that Gibbs immediately recognizes from a similar one on his uncle’s farm, used to turn milk into powder. The unit is clean now, but she found traces of the virus, which means it’s now transmissible by air. That’s not good. Gibbs races out.

And we’re at the football stadium with 60,000 potential targets. We see the military bigwigs entering, and we also see two men dressed in pest-control gear, one carrying a big tank with a sprayer attachment. Ruh roh! Ziva says there is still time to evacuate, but Gibbs is concerned that if they try to clear the stadium, they’ll just release the virus. McGee says they are looking for pressurized containers that wouldn’t look out of place in a public place. We get the team spreading out as the men with the tanks draw ever closer. We get a Blue Angels flyover (never fails to give me goose bumps) as the Star Spangled Banner is played. Abby calls Gibbs to tell her that she finished processing the traces of virus from the powderizer machine, and there’s not enough for a large-scale attack. Maybe only a few dozen people. She’s worried they have the wrong location. Gibbs doesn’t think they do, they just have to find the tanks. He calls McGee, gets the location for where the bigwigs from all five branches of the military will be seated. Naturally, it’s at the top of the stadium. They spot the men with tanks and fan out and head up. One security guard is found shot dead.

Up on the roof, Fornell and Gibbs spy the men about to unload the tank contents into the air vents. They’re readying themselves to spring into attack, and Gibbs chooses that moment to go, “Condom under the fold? Really, Tobias?” HA! He says it’s the same one he had in college. Aw, poor Tobias.

They split up and close in, hoping, of course, the two men won’t release the virus on them. One of the men is Slick! We knew we never liked him! Gunfire is exchanged. The other guy tries to run, but Ziva tops the steps and takes him out. Tony and McGee start running. Slick makes one last move to turn the tanks on, and Gibbs and Fornell move in at the same time and take him out. A dying Slick tells them they don’t even know what they’re fighting for and expires. Tony says he’s not feeling very “homeland-y” or secure.

In Vance’s office, he wants to know why a Homeland employee just tried to commit an act of terrorism. Fornell and Gibbs explain it was supposed to look like a terrorist attack, but was actually an assassination attempt on the military’s top policymakers. They were in town to draw up a massive slowdown of the military contracts. They found a hit list on Slick’s computer, but they don’t know who he was working for. They have a list of folks who don’t want to see that kind of slowdown happen, military contractors and the like, and it’s likely one of them, but no way to tell which one. Vance calls it a “bone sandwich,” but Gibbs jokes that at least he cut off the crust for him. Vance hands the case to the FBI to follow up on the list of possible suspects, a task which Fornell is less than enthusiastic about handling. Gibbs tells him to cheer up, that at least he doesn’t have to talk to Diane again. Fornell corrects him, says they have a child together. He’ll never be rid of her. Gibbs smiles, and is all, “Oh, right. I guess I just won’t have to.” HA!

Back in his basement, Gibbs is putting a screen on the door he was painting before, as Diane comes down the stairs. He tells her he’s out of bourbon, but she didn’t come for a nightcap. She pokes around, and the mood is quiet, contemplative, when she says she knows he used to come down there to avoid her. He says he didn’t mean to hurt her, and she says she knows. She says she wasn’t the easiest person to live with, and he smiles and says he would agree with that. They both smile, and she thanks him for finding Victor. Gibbs says Victor helped to save a lot of people, that he’s a good man. She asks Gibbs to tell Tobias she never meant to hurt him. Gibbs says he knows. Then adds, “I think.” Heh. She said she really liked him (Tobias) but never should have married him. She said she never loved him, the same way Gibbs never loved her. He tells her that he liked her, says he still does. She says the only woman he’ll ever love is Shannon. He doesn’t respond, but his expression says it all. She moves in closer, touches his cheek. He lets her. She opens his hand and lays his grandfather’s watch on his palm. Then she tells him that he is her Shannon. Aw. He looks at the watch as she exits, then looks up the stairs after she departs. Fade to black and white.

Ahhhh … some of my favorite episodes are with this particular Devil’s Triangle. With Gibbs and Fornell, we know we’re always in for a good time, with those occasional emotional gut grabbing moments as well. This was definitely one of those. (I think they need to do a new hybrid “faux reality” show where the characters of Gibbs and Fornell do some kind of road rally/road trip together. They could race against teams of our favorite character pairs from other TV shows. In character. It could film in the summer when they’re all on hiatus from their regular show. All teams playing for their favorite charity, natch. Honestly, someone, get me a pitch meeting!)

While I’m holding my breath waiting for that to happen, let’s talk about season 14! Summer is winding down and the fall season is mercifully almost upon us. Season 14 premieres just four Tuesdays from rightthisverysecond! (Sept. 20! Mark your calendars!) We have not one, not two, but THREE new regular cast members coming our way. (See photos above!) And as much as I will miss Tony, I, for one, am excited about the possibilities! More on all that when we get closer to the premiere.
